This is in response to reports in certain media that Paramahamsa Nithyananda has willfully avoided receiving a summons from the Madurai First Additional District and Sessions Judge in relation to a complaint by two Chennai-based individuals challenging his coronation as the 293rd pontiff of Shyamala Peetha Sarvajnapeetham.
With regard to this, we wish to clarify the following:
1) The two individuals Manivasagam and Sami Thiagarajan had filed a civil suit, not a complaint as mentioned. A civil suit is between two individuals and hence a summons is the only procedure to be followed by the court, as no complaint has been filed.
2) The two individuals had filed a main suit as well as an interim prayer.
3) As per common procedure, the court had sent a summons for the main petition, WHICH HAS BEEN RECEIVED BY US.
4) The summons for the interim prayer was sent to Shyamala Peetha Sarvajnapeetham on 3rd July, when Paramahamsa Nithyananda was away from Shyamala Peetha Sarvajnapeetham for the Guru Poornima celebrations at Nithyananda Dhyanapeetam’s Tiruvannamalai Ashram. Hence he could not receive the summons, as he was not present in Shyamala Peetha Sarvajnapeetham on that day.
5) Hence, the case has been posted for 24th July.
6) Contrary to what is being reported, an arrest warrant cannot be issued on a civil suit.
This is a most common order, which has unfortunately been blown out of proportion and sensationalized by certain sections of the media.
We hope that this clarifies the issue for the benefit of all media.
